Anyone who has driven on Illinois roadways during the summer months can attest that construction zones are everywhere. Resurfacing or repaving, road widening, and bridge reconstruction projects, among others, are a high priority for local, county, and state authorities, as the safety of motorists must be protected. This can present challenges, though, as drivers who are accustomed to maintaining a particular schedule or driving pattern may have trouble adjusting to the state-mandated lower speed limits of construction zones. Keeping roadway workers safe is also a priority, and, as such, penalties for speeding in a work zone are more severe than most other traffic violations. Throughout the state of Illinois, construction zone speed limits are not permitted to exceed 45 miles per hour (mph) when workers are present, regardless of the limits in the surrounding areas. Additionally, a construction zone must be clearly marked with visible speed limit and road work signs. A work area must also include a notification sign with the minimum fine clearly listed.
Unlike other traffic offenses, whose seriousness if often dependent upon repeat or cumulative violations, the penalty for speeding in a construction zone is increased even for first offense. First-time offenders are required to pay a minimum fine of $375. A second or subsequent offense carries a minimum fine of $1,000. In addition, if the second offense occurs within two years of the first, the offender’s driving privileges will be suspended for 90 days.
