10 Tips for Interacting With the Police

Many people find themselves in situations where they do not know the correct protocol for communicating with a police officer. This can lead to increased anxiety, or worse yet, criminal charges. Here are 10 tips on how to respond in such a situation.

How to Handle Police Interactions in DuPage County

It is important for everyone to understand how to handle interactions with law enforcement. There are actions you can take as well as actions you can refrain from that will decrease the chances of a police interaction escalating.

If you are involved in an interaction with the police, be sure that you:

  • Remain Calm – It is important to remain calm and polite when interacting with the police. Yelling, getting angry, or making threatening remarks will not help the situation and can result in criminal charges.
  • Do Not Run – Never speed away from or try to physically resist an officer. This could result in criminal charges and possibly physical harm to yourself or the police officer. Illinois law requires drivers to pull over when they see flashing lights or hear a siren behind them. Failing to stop can lead to criminal charges for fleeing or attempting to elude a police officer.
  • Make the Officer Feel at Ease - A recent report found that 73 police officers were intentionally killed while performing duties in 2021. Police officers never know what they will encounter while on duty, so it is important to not only remain calm but also make the officer feel comfortable.
  • Put Your Hands Where the Officer Can See Them – This is especially important during any type of traffic stop. Before you even open your window, put both hands on the wheel and let the officer know that you are following their instructions.
  • Do Not Consent to a Search – This does not mean that you are being uncooperative, but it is your legal right to refuse a search. Calmly say "I do not consent to a search." If the police have probable cause to suspect criminal activity, they may conduct a search without your permission. However, if they do not have probable cause, it is important that you protect your rights by declining a search. If police find evidence during an unwarranted search, it may be thrown out in court.
  • Be Respectful – In any situation, it is important to show respect for the police officer. This does not mean that you have to agree with their decisions or comply with all requests but being respectful can go a long way.
  • Stay Silent if You Are Arrested – Police officers are allowed to ask questions and record your responses, but it is important to remember that you do not have to provide any information. Saying something that could be used against you later is never a good idea. It is best to remain silent and request an attorney as soon as possible.
  • Do Not Resist Arrest – It is important to remain calm when being arrested. Do not resist, try to run away, or make any aggressive moves as this could result in additional charges.
  • Do Not Answer Questions During an Interrogation – If you are arrested on suspicion of a crime, the police will want to ask you questions. The purpose of an interrogation like this is to get you to provide incriminating evidence. You have a right to refuse police interrogations and you should always do so.
  • Contact a Lawyer – If you are arrested, it is important to contact a lawyer as soon as possible. You have a right to an attorney, and they will be able to inform you of your rights and provide legal advice.
